The French want Bell Labs and Lucent: French Takeover of Lucent (including technology gem Bell Labs) should Come Under Close Scrutiny by CFIUS

On March 23, a gaggle of organizations representing the financial industry sent a letter to Sen. Richard Shelby (R-AL), chairman of the Senate Banking Committee. The group included the American Bankers Association, the Bankers’ Association for Finance and Trade, the Investment Company Institute, the Securities Industry Association, the Bond Market Association, the Financial Services Forum and the Financial Services Roundtable. They wrote in opposition to strengthening the Committee on Foreign Investment in the United States (CFIUS), a reform effort that Sen. Shelby is leading. (For the record, we have our doubts that Shelby will get it completely right as he doesn’t want his banking Committee to lose jurisdiction of Treasury-led CFIUS, whose chairmanship clearly needs to be moved to Defense, Homeland Security or Justice.).

The famous Bell Labs is part of Lucent, so Alcatel’s purchase will also be an example of foreign finance being used to acquire American technology, not to infuse the U.S. economy with foreign innovation as the bankers argued. This is almost always the case in the area of CFIUS concern, defense capability. The United States spends five times as much on military research and development as do members of the European Union. As Richard Olver, chairman of Britain’s largest defense firm BAE, told Defense News (Feb. 25, 2005), “It’s obviously clear that the extent of R&D in the United States is a very different order of magnitude to the R&D investment in the rest of the world, including the United Kingdom….so our first line of strategy is to have a bias to grow in the United States.” Why take the risk of investing in R&D when a firm can just wait and buy up the results later? The French are particularly keen on this strategy, with its leading defense electronics firm Thales announcing last month a new campaign to acquire “second-tier” U.S. defense contractors.

If American firms tried to buy French firms in similar industries, they would be prohibited from doing so. Thales, for example, is one-third owned by the French government whose ‘golden shares” would block any deal. Last August 31, Paris announced that it would protect from foreign buyouts firms in strategic domestic industries. French Finance Minister Thierry Breton stated that the country’s “very sensitive sectors” would be shielded from foreign bids. While the complete list of protected industries has not been made public, some information has leaked out. Telecommunications companies are on the protected list. So Lucent could not takeover Alcatel. Defense, biotechnology, space technology, casinos, encryption, IT security, and some medical suppliers are also reportedly on the list.

Now United Arab Emirates wants even companies that make parts for the next generation of fighters and main battle tanks for the U.S.

WASHINGTON [MENL] — The Bush administration has approved a takeover by the United Arab Emirates of a leading subcontractor for the U.S. military.

President Bush has endorsed a recommendation of the Committee on Foreign Investment in the United States for a UAE state-owned company to acquire the British-based Doncasters Group. Doncasters, with nine factories in the United States, has produced components for aircraft and main battle tanks.

The probate judge who ordered the dehydration death of brain-injured Terri Schiavo will join Michael Schiavo and other key proponents of her death as a guest speaker at a bioethics conference.

Florida Circuit Court Judge George Greer on Monday will address attendees of the University of Pennsylvania Center for Bioethics 10th anniversary symposium, entitled “The legacy of the Terri Schiavo case: Why is it so hard to die in America?”

Greer intends to speak to the need for courts, not legislators, to decide the fate of incapacitated individuals like the 41-year-old Florida woman whose husband obtained Greer’s authority to remove her feeding tube and cause her death, over the objections of Terri’s parents and siblings.

Bobby Schindler, Terri Schiavo’s brother, calls Greer’s speaking engagement “offensive,” and on behalf of the Terri Schindler Schiavo Foundation Center for Health Care Ethics intends to protest Geer’s presence at 10:30 a.m. Monday outside of the university’s Biomedical Research Building.

“Judge Greer’s presence at the University of Pennsylvania’s bioethics conference is not only outright offensive and inappropriate but it is indicative of his own biases against the disabled, and may well be in violation of Florida’s judicial canons as prescribed by the Supreme Court of the State of Florida,” Schindler stated in a press release. “Judge Greer is confirming exactly what my family has maintained from the beginning of Terri’s case – that he has a disposition against the vulnerable people whose cases he controls.”

News of the decriminalization did not make the front pages of any major Mexico City newspaper, nor was it discussed in editorials. It was slightly better publicized in the north of the country, where turf wars between rival drugs gangs have caused hundreds of killings along the Mexico-U.S. border, but was still overshadowed by news about immigration.

In Mexico City’s stylish Zona Rosa neighborhood, Mexicans and tourists alike were surprised to hear it could soon be legal to carry small amounts of drugs.
